what was giz warned for? i don't see any bashing of the administration.
also you didn't even state that you were warning him. you just said you'd start being more strict.
and actually broke what you stated in the tos by banning him right away. nice work being strict, im. you really followed the tos directly. i salute you. :flamedevil:

... Well. No major flaming there, as far as I can tell. There was the hit on the TOS and it's enforcers, but basically that was all. There is a lot of poking, prodding, and it seemed like he was asking IM to remove his power. In a way, a week of reflection isn't nearly as harsh as what the Giz was asking for originally. We'll see Giz again shortly. Sad...

Happycat makes my day though. JSH, you get blue text, in memory of the cooler times we had here.

I don't think a week-long ban for implied questioning of authority is appropriate, though from IM's standpoint he's had to put up with complaints about Giz for months on end. About as many as he gets about SA too, but that's another issue alltogether. Still, what's at the whole heart of the matter is the interpretation of things. I'd be half tempted to say that if Squall had handled this, there'd be a different result, just because he'd interpret the TOS differently. Or Orchy, or Setu, or Uncy, or CN. Same setup, different cast, and I bet Giz would've done differently.

Regardless, you can't un-do a ban. Well, you could, but you can't undo the fact Giz was banned. I'm still hoping something worthwhile comes out of this whole mess.

Oh yeah. Not blackmail. Bribery, maybe. Although there really isn't much IM has to gain from taking Giz's powers of Mod away. More like something to lose, really. A lose lose situation.

This is oddly similar to another past event. Remember GTA3? There was a porn game programmed into it, but it wasn't accessable without an outside hack. Because it was possible, through a third party, to access it, even though it wasn't part of the game, they raised the rating to AO. Pretty much everyone who's not a soccer mom thinks that was stupid and pointless. It would be different if you could access the game from the menu, but you couldn't. Given only the game and a PS2, there was no way to access the game.

The same is true with this. You may have found ROMs hosted on the site, but they were for other purposes. We're not encouraging users to download them, and never even linked to them. Were one of the admins to post a link to the site, then that admin would have broken the rule, and would have been punished (I know you don't believe that, but doing that actually falls under the "Do not start a topic that encourages illegal activites." and there's no doubt that it would be against the rules).

If I wanted to be a jerk, I could point out that, until now, no one has actually posted a link to a place with ROMs on it...until you just now.

It makes sense; it's unfair to claim that we're making a post that supports transmitting ROMs, just as it's unfair to claim the makers of GTA3 are selling sex games to kids. A whole bunch of stuff is hosted on CP, and practically none of it is made public to the boards or journals; which are the only places that are under the terms of service.

The rule doesn't say "no illegal content", it says not to make a post that supports illegal activity. If IM had made a post that said "Hot Q-Bert romz. Get em here!1" then you would have a case.

#paradoxlounge and #castleparadox are seperate entities than the castleparadox.com forums and journals. They are governed by their own set of rules, and ops. Quite frankly, I don't care if you go in there and start swapping child pornography; I concern myself with the boards and journals. The ops of the irc rooms make the decision what to punish and what not to punish, and generally speaking, irc is moderated a lot less than everything else here.
