Overruled! The fact remains that the witness was not speaking about the future state of the board. His statement was true when it was made. A person cannot become a liar retroactively.

Sure we can overrule it, since that was a statement made about the PAST. Claiming a past statement applies to present events is idiotic at best, insane at worst. Let us take an extreme example of what you've just done.
In spring of 1905, I make the claim "Adolf Hitler is a nice person." Since Hitler is 6 years old at the time, and hasn't killed anyone or done anything he later became infamous for, the statement is correct. In 1905.
Later on, some quack-historian takes that exact statement and applies it to Hitler of 1944, after killing Jews and triggering WWII, among other such war crimes. Clearly "Adolf Hitler is a nice person" no longer hold true in 1944.
Unless you count killing Jews a sign of being a nice person, in which case I'd recommend you get hit by an ice cream truck. Most everyone likes ice cream, you can sue the driver for negligence and come out with cash, and we'll all laugh a little on the inside. Everyone wins.  !
Also, as of 11:41 CST you've got 5 members. And the 19 users were all guests from some internet site 4ch, giggling at the thanksgiving javascript you've got enabled. |
