Fanfictions and fanart are technically illegal (as you are using someone else's characters, and it does not fall under Fair Use, by the way) but nobody has really persued it yet due to the legal cost and time it takes to do so.

However, most videogame companies like Nintendo, Sega, and SquareEnix will grant you permission to make a fan-something as long as you ask nicely. Nintendo.com even used to have a blurb on their site about how you could have a fan-game given the "Nintendo Seal of Quality" unofficially by it's staff if it was good enough, but it probably became too much of a legal hassle.

That's news to me, but doesn't it still depend on how you use them? I mean, if I draw a picture of Mickey Mouse and stick it on my wall, is that really illegal?

As far as I'm concerned with regard to property ownership, just get the original author's permission to do so. If anything, they could clear up a few questions about how their characters might act, which would help the fanfic author out some

The point remains though: Fyre is, TECHNICALLY, correct. However, as he says, most copyright holders aren't going to go after every person who makes fanart. Most likely, they won't go after anyone, as most art creators, I'd like to think, enjoy a certain measure of fame and such.
